Terms of use
Last updated [date of publication]
This is a draft under legal review and is not yet in force. Questions about your data go to support@hoshiastro.com.
These terms are an agreement between you and BG Media LLC ("we") for using the Hoshi app and hoshiastro.com. By using Hoshi, you agree to them. If you don't agree, please don't use Hoshi.
Who can use Hoshi
You must be at least [13] years old. If you're under 18, you need a parent's or guardian's permission, and they agree to these terms for you. You're responsible for what happens on your account, so keep your sign-in to yourself.
What readings are
Hoshi writes readings from astrological charts, for reflection and entertainment. They aren't advice of any kind: not medical, psychological, financial or legal, and not a prediction of how any relationship will turn out. Don't make important decisions based on them.
Readings are written with AI and can be wrong, incomplete or strange. Use your own judgment.
Adding other people
You can add people you know by entering their name and birthday. When you do:
- Only add real people you actually know, with details you were given or already know.
- Don't use Hoshi to harass, embarrass, stalk or pressure anyone, or to share readings about someone to hurt them.
- What you enter about someone is visible only to you. If they ask, remove them.
We can remove profiles, readings or links that break these rules.
Subscriptions and free trials
Some features need a subscription. Subscriptions are sold and billed by Apple through your Apple account, and renew automatically at the end of each period, at the price shown when you subscribed, until you cancel. Cancel at least 24 hours before the period ends in iPhone Settings → your name → Subscriptions. Deleting the app or your account doesn't cancel it.
A free trial turns into a paid subscription when it ends unless you cancel before then.
Refunds are handled by Apple under its policies; ask at reportaproblem.apple.com. [Lawyer: state-specific auto-renewal disclosures, and the EU/UK 14-day withdrawal right for digital content and how it's waived when the service starts.]
Your license to use Hoshi
We give you a personal, non-exclusive, non-transferable, revocable license to use Hoshi for yourself, under these terms. Don't copy, resell, reverse engineer, scrape or interfere with Hoshi, or use it to build a competing product.
Content
Yours: what you enter (names, birth details, notes) stays yours. You give us permission to store and process it to run Hoshi for you.
Ours: the app, the readings' design, text written by Hoshi, and our names and logos belong to us or our licensors. You can keep and share the readings Hoshi writes for you, for personal, non-commercial use.
Feedback: if you send us ideas or suggestions, we can use them without owing you anything.
Copyright complaints
If you believe something on Hoshi infringes your copyright, send a notice to our designated agent under the DMCA: [agent name], BG Media LLC, 233 W 38th St, New York, NY 10018, USA, [email]. Include the work, where it appears on Hoshi, your contact details, a statement of good-faith belief, a statement that the notice is accurate under penalty of perjury, and your signature.
Apple
These terms are between you and us, not Apple. Apple isn't responsible for Hoshi or its content, has no obligation to provide support or maintenance for it, and, to the extent allowed by law, has no warranty obligation for it. Apple isn't responsible for handling claims about Hoshi (including product liability, legal compliance or intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you're not in a country under a US embargo or on a US prohibited-party list.
Ending your account
You can delete your account at any time in the app. We can suspend or end accounts that break these terms or put others at risk, and we'll tell you why when we can. Parts of these terms that by their nature should continue (content, disclaimers, liability, disputes) still apply after.
Disclaimers
Hoshi is provided "as is" and "as available". To the extent allowed by law, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise Hoshi will be accurate, uninterrupted or error-free.
Limitation of liability
To the extent allowed by law, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about Hoshi is limited to the greater of what you paid for Hoshi in the 12 months before the claim and $50. Some places don't allow these limits, so they may not apply to you.
Disputes between users
Hoshi isn't a party to disagreements between you and other people about readings or connections, though we'll act on reports that break these terms.
Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. [Lawyer: courts of New York County, or binding arbitration with a class-action waiver and an opt-out window.] If you live in the EU or UK, you also keep the protections of your local consumer law.
Changes to these terms
When we change them, we'll update the date above, and tell you in the app or by email before a significant change takes effect. Using Hoshi after that means you accept the new terms.
